myAVA (Activity Value Assistant) is provided by ARK Advisory Group (“we”, “us”). When you use myAVA you are entering into an agreement with ARK Advisory Group. If you are signing up on behalf of a company, you confirm you have authority to do so; if you are signing up for yourself, you confirm you are of legal age.
Accepting these terms
By creating an account or continuing to use myAVA, you agree to these terms. If you do not agree, please stop using the service.
What myAVA does
myAVA is a personal work log. It lets you record hours, overnight fees, expenses, notes and receipts, group them into pay periods, send summaries to whoever pays you, and export reports. myAVA does not pay you, invoice on your behalf, or provide accounting, tax or legal advice.
Your account
- Keep your sign-in details confidential; you are responsible for activity on your account.
- Give accurate information and keep it up to date.
- You keep ownership of the entries, receipts and notes you add. You grant us a limited licence to store and process them only to provide the service to you.
Acceptable use
You must not:
- use myAVA for anything unlawful, fraudulent or deceptive, including submitting false records to obtain payment;
- send spam, or upload malware or harmful code;
- infringe anyone's intellectual property or privacy;
- probe, scrape, overload or otherwise interfere with the security or operation of the service;
- reverse engineer, resell, redistribute or circumvent technical limits of the service.
Our intellectual property
ARK Advisory Group owns myAVA and everything in it apart from your own content — the software, design, documentation and branding. You receive a limited, non-exclusive, non-transferable right to use myAVA under the plan you have chosen.
Availability
We work to keep myAVA running well, but we do not guarantee it will be uninterrupted, error-free or always available. Features may change or be withdrawn as the product evolves.
Payments and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Billing, renewals, taxes, cancellations and refunds are handled under Paddle's Buyer Terms. Subscriptions renew automatically at the price shown when you subscribe, until you cancel. You can cancel at any time; cancellation takes effect at the end of the period you have already paid for. Our Refund Policy explains how to get your money back.
Free trials and promotional codes
A free trial gives you full access for the stated period at no cost and with no card required. When it ends, your data stays safe and readable, but adding or editing entries requires a paid plan. Promotional and referral credits have no cash value and can be withdrawn if they are obtained through abuse.
Receipts and how long we keep them
Receipt photos are optimised (resized and compressed) when you upload them, so they stay readable while using far less storage. We keep receipt image files for seven years from the date they are uploaded. After that, the image file is deleted automatically and the expense record it belongs to — date, merchant, amount, category and notes — is kept in your history. You can delete any receipt yourself at any time.
Seven years reflects common record-keeping practice, but you are responsible for your own tax and accounting records. If you need to keep a receipt image for longer, download or export it before the seven years are up.
Suspension and termination
We may suspend or end your access if you materially breach these terms, do not pay, create a security or fraud risk, or repeatedly or seriously break the rules above. You may close your account at any time. After your access ends you can export your data for a reasonable period before it is deleted.
Warranties and liability
To the fullest extent permitted by law, myAVA is provided “as is” and we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect or consequential loss, including lost profits, lost data or lost goodwill. Our total liability is limited to the fees you paid in the twelve months before the claim. Nothing here excludes liability for fraud, death or personal injury where the law does not allow it.
You agree to cover claims arising from your content, your unlawful use of the service, or your breach of these terms.
General
- These terms are governed by the laws of the State of California, United States, and its courts have jurisdiction.
- You may not transfer your account without our consent; we may assign these terms as part of a merger or sale of the business.
- Neither of us is responsible for delays caused by events outside our reasonable control.
- We may update these terms; material changes will be announced in the app or by email.
